These Terms & Conditions (“Terms”) govern your use of the DB Waste and Recycling Pty Ltd website and the supply of waste collection and recycling services by DB Waste and Recycling Pty Ltd (“DB Waste”, “we”, “us” or “our”).
By using this website, requesting our services, accepting a quotation, booking a service, or otherwise engaging DB Waste, you agree to these Terms, together with any applicable quotation, service agreement, pricing schedule, or other written agreement provided to you.
If you do not agree with these Terms, please do not use our website or request our services.

2. Our Services

DB Waste provides waste collection and recycling services, which may include:
● General Waste collection
● Commingled Recycling collection
● Cardboard Recycling collection
● FOGO (Food Organics and Garden Organics) collection
● Construction & Demolition (C&D) waste collection
● E-Waste collection
Other waste management services agreed between DB Waste and the customer

Available bin sizes may include:
● 80L
● 120L
● 240L
● 660L
● 1100L
The availability of particular services, waste streams, bin sizes and collection frequencies may vary depending on the customer’s location, requirements, applicable regulations, and DB Waste’s operational capacity.

3. Quotations and Pricing

Unless otherwise stated in writing, quotations provided by DB Waste are based on the information supplied by the customer at the time of quotation.
A quotation may take into consideration factors including:

● Bin size
● Waste stream
● Number of bins
● Collection frequency
● Service location
● Access requirements
● Estimated waste volume
● Weight limits, where applicable
● Additional service requirements
● Applicable disposal, treatment or processing costs

A quotation is not binding until accepted by the customer and confirmed by DB Waste.
Unless expressly stated otherwise, quoted prices are exclusive of GST where GST is applicable.
Pricing may be subject to additional charges where the actual service requirements differ materially from the information provided when the quotation was prepared.

4. Service Agreements

Where a customer enters into a written service agreement with DB Waste, the terms of that agreement will apply to the extent of any inconsistency with these website Terms.
Specific pricing, collection schedules, service locations, payment terms and other commercial arrangements may be documented separately in a quotation, service agreement or other written confirmation.

5. Collection Schedules

DB Waste will provide collection services according to the agreed schedule, subject to operational requirements and circumstances beyond our reasonable control.
Collection times may vary due to:

● Traffic
● Weather
● Road conditions
● Vehicle or equipment issues
● Driver availability
● Access restrictions
● Public holidays
● Emergency situations
● Changes to collection routes
● Other circumstances affecting normal operations

Where reasonably practicable, DB Waste will communicate significant service changes or delays.
A scheduled collection time should not be interpreted as a guaranteed exact arrival time unless expressly agreed in writing.

6. Customer Responsibilities

Customers are responsible for ensuring that:

Bins are placed in an accessible location for collection.
Bins are available at the agreed collection time.
Access to the collection location is safe and reasonably unobstructed.
Waste is placed in the appropriate bin.
Waste does not exceed applicable bin capacity or weight limits.
Prohibited or unsafe materials are not placed in bins.
The information provided to DB Waste about waste types, quantities and service requirements is accurate.
Any relevant access restrictions or site-specific requirements are communicated to DB Waste.

Customers must notify DB Waste of any material change to their service location, access arrangements, waste type, bin requirements or collection requirements.

7. Bin Placement and Access

Customers must ensure that bins are positioned in a location that can be safely accessed by DB Waste personnel and collection vehicles.
Where a bin cannot be safely accessed, the collection may be delayed, partially completed, or recorded as an unsuccessful collection.
Additional charges may apply where a service cannot be completed because of circumstances within the customer’s control, subject to the applicable quotation or service agreement.

8. Unsuccessful or Futile Collections

A collection may be classified as unsuccessful or futile where DB Waste attends the scheduled service location but is unable to complete the collection due to circumstances such as:

● The required bin is not present.
● The bin cannot be accessed.
● The bin is blocked or obstructed.
● The site is inaccessible.
● The bin is not presented in accordance with the agreed collection requirements.
● Other circumstances prevent the scheduled service from being completed.

Where applicable, a futile or unsuccessful collection charge may be applied in accordance with the customer’s agreed pricing arrangement.

9. Waste Classification and Contamination

Customers are responsible for placing waste in the correct bin and waste stream.
Where waste is incorrectly placed, contaminated, hazardous, prohibited, or materially different from the waste stream agreed with DB Waste, additional charges may apply and DB Waste may refuse, partially complete, or otherwise manage the collection where reasonably necessary for safety or compliance.
Where appropriate, DB Waste may contact the customer regarding contamination or incorrect waste classification.

10. Weight Limits and Additional Charges

Certain waste streams or services may be subject to agreed weight limits.
Where an applicable weight limit is exceeded, additional charges may be applied in accordance with the customer’s agreed pricing arrangement.
The applicable weight limit and excess weight rate may vary depending on the waste stream, bin size, customer agreement and service arrangement.
Where weight-based charges apply, the weight recorded or otherwise reasonably determined during the service may be used to calculate applicable additional charges.

11. Prohibited and Unsafe Materials

Customers must not place prohibited, dangerous, hazardous, explosive, flammable, toxic, infectious, or otherwise unsafe materials into bins unless DB Waste has expressly agreed in writing to accept those materials and the appropriate arrangements have been made.
Examples may include materials that require specialised handling, treatment, transport or disposal.
If DB Waste reasonably believes that waste presents a health, safety, environmental or regulatory risk, we may refuse collection, isolate the relevant material where reasonably necessary, or take other appropriate action.
Any additional costs arising from incorrectly declared, prohibited or unsafe waste may be charged to the customer where permitted by the applicable agreement and law.

12. Bin Ownership and Care

Unless otherwise agreed in writing, bins supplied by DB Waste remain the property of DB Waste.
Customers must take reasonable care of bins while they are located at the customer’s premises or under the customer’s control.
Customers must not:

● Modify or permanently alter bins.
● Remove identifying labels or markings.
● Transfer bins to another location without approval.
● Sell, dispose of or otherwise transfer ownership of DB Waste bins.

Customers should promptly report damaged, lost, stolen or missing bins.
Charges may apply for replacement, repair or relocation where permitted under the applicable agreement.

13. Service Changes and Additional Services

Customers may request changes to:

● Bin size
● Number of bins
● Waste stream
● Collection frequency
● Service location
● Additional or one-off collections

Changes are subject to availability and confirmation by DB Waste.
Additional charges may apply depending on the requested change.

14. Cancellation and Suspension

Customers may cancel or suspend services in accordance with the applicable quotation, service agreement or agreed cancellation terms.
Where no specific cancellation terms have been agreed, reasonable notice should be provided.
DB Waste may suspend or refuse services where reasonably necessary, including where:

● Invoices remain unpaid;
● The customer materially breaches these Terms or an applicable agreement;
● A site presents a safety risk;
● Waste is prohibited or materially different from the agreed waste stream;
● Access is repeatedly unavailable;
● Continued service would create legal, regulatory, environmental or operational concerns.

Any suspension or cancellation will remain subject to applicable law and any specific contractual rights of the parties.

15. Invoicing and Payment

DB Waste may issue invoices electronically.
Invoices will specify the applicable charges and payment terms.
Customers are responsible for paying invoices by the due date stated on the invoice or in the applicable agreement.
Payment methods may include electronic payment or other methods made available by DB Waste.
Where an invoice remains unpaid after its due date, DB Waste may take reasonable steps to recover the outstanding amount and may suspend services where permitted by the applicable agreement and law.
Any applicable fees, interest or recovery costs will only be charged where permitted by the applicable agreement and law.

16. Payment Disputes

If a customer believes an invoice contains an error, the customer should contact DB Waste as soon as reasonably practicable and provide details of the disputed amount.
Customers should not withhold undisputed amounts solely because another amount is being disputed.
DB Waste will review genuine billing disputes and work with the customer to resolve them.

17. Missed or Incomplete Collections

If a scheduled collection is missed or not completed, customers should contact DB Waste as soon as reasonably practicable.
We will investigate the issue and, where appropriate, arrange a suitable resolution.
Collection delays or failures caused by circumstances outside DB Waste’s reasonable control will be handled in accordance with Section 18.

18. Events Outside Our Reasonable Control

DB Waste will not be responsible for delays or inability to provide services where caused by circumstances beyond our reasonable control, including but not limited to:

● Severe weather
● Floods
● Fires
● Natural disasters
● Road closures
● Accidents
● Government restrictions
● Industrial action
● Public emergencies
● Major equipment failures
● Third-party disruptions
● Unexpected operational restrictions
● Other events beyond our reasonable control

Where reasonably practicable, DB Waste will take reasonable steps to minimize disruption and resume services as soon as practical.

19. Website Information

We aim to ensure that information on our website is accurate and current.
However, website content is provided for general information and may change without notice.
Information about services, bin sizes, waste streams, availability, collection arrangements and pricing should not be treated as a binding offer unless expressly confirmed by DB Waste in writing.

20. Website Use

You agree to use our website lawfully and responsibly.
You must not:

● Use the website for unlawful purposes.
● Attempt to gain unauthorized access to our systems.
● Interfere with the operation or security of the website.
● Submit false, misleading or fraudulent information.
● Upload malicious software or harmful code.
● Copy, reproduce or commercially exploit website content without permission.

21. Intellectual Property

Unless otherwise stated, content on this website, including text, branding, logos, images, graphics, designs and other materials, is owned by or licensed to DB Waste and is protected by applicable intellectual property laws.
You must not reproduce, modify, distribute, publish or commercially exploit our website content without our prior written permission, except where permitted by law.

22. Complaints and Service Issues

We encourage customers to contact us as soon as possible if they have a concern regarding our services.
Our customer service team will review the matter and work with the customer toward a reasonable resolution.

Our collection and handling of personal information is governed by our Privacy Policy, which is available on our website.
By using our website or providing personal information to us, you acknowledge that your information may be handled in accordance with that Privacy Policy and applicable privacy laws.

24. Changes to These Terms

DB Waste may update these Terms from time to time to reflect changes to our services, business practices, technology or applicable legal requirements.
The updated Terms will be published on our website with a revised “Last Updated” date.
Changes will not affect rights or obligations that have already accrued under an existing agreement unless permitted by law or agreed between the parties.
